Terms of Use for Beta Software

1. Introduction

These Terms of Use ("Terms") govern the use of any software or services provided in beta form ("Beta Software") by PlingifyPlug ("we," "our," or "us"). By accessing, downloading, or using our Beta Software, you ("User," "you," or "your") agree to be bound by these Terms. If you do not agree with any part of these Terms, you must immediately discontinue your use of the Beta Software.

2. Acknowledgement of Beta Software Status

The Beta Software is still under development and is provided to you for testing, evaluation, and feedback purposes only. By using the Beta Software, you acknowledge and accept full responsibility for your use of the software. You agree that you will use the Beta Software solely for its intended purpose and will not hold PlingifyPlug, its employees, contractors, or affiliates liable for any direct, indirect, incidental, consequential, or special damages arising from the use of the Beta Software, including, but not limited to, data loss, system failures, crashes, or any other negative impacts on your device or network. You are solely responsible for any risks associated with testing and using the Beta Software, including potential loss of data, security vulnerabilities, or software malfunctions.

4. No Warranty

The Beta Software is provided "as is," and PlingifyPlug makes no representations or warranties regarding the Beta Software, including but not limited to its quality, performance, security, or availability. We expressly disclaim all warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. There is no guarantee that the Beta Software will meet your expectations or be free from errors or interruptions. PlingifyPlug is not responsible for any damage, including loss of data, arising from your use of the Beta Software.

5. Feedback and Testing

By using the Beta Software, you may be requested to provide feedback, bug reports, and suggestions ("Feedback") to PlingifyPlug. You agree that any Feedback you provide will be non-confidential and may be used by PlingifyPlug for any purpose, without compensation to you. You acknowledge that PlingifyPlug may, but is not obligated to, incorporate any suggestions or improvements you provide into future versions of the Beta Software or other products and services.

6. Limitations of Liability

In no event shall PlingifyPlug be liable for any damages, including but not limited to, direct, indirect, incidental, special, or consequential damages, or loss of profits, data, or use, whether in an action of contract, negligence, or other tortious action, arising out of or in connection with the use or inability to use the Beta Software, even if PlingifyPlug has been advised of the possibility of such damages. The total liability of PlingifyPlug in any matter arising from the use of the Beta Software shall not exceed the amount you paid, if any, for the Beta Software.

7. No Support

PlingifyPlug is under no obligation to provide support, updates, maintenance, or any form of assistance for the Beta Software. If we choose to offer support or updates for the Beta Software, it will be at our discretion and may be limited to certain periods or conditions.

8. Modifications and Termination

PlingifyPlug reserves the right, at our sole discretion, to modify, suspend, or terminate the Beta Software or your access to the Beta Software at any time and without notice. We may also discontinue the Beta Software entirely or release future versions under different terms and conditions. You agree that we will not be held liable for any loss or inconvenience resulting from the modification, suspension, or termination of the Beta Software.

9. Indemnification

You agree to indemnify, defend, and hold harmless PlingifyPlug, its officers, employees, agents, and affiliates from any claims, damages, losses, or expenses, including reasonable attorney’s fees, arising out of or in connection with your use of the Beta Software, violation of these Terms, or violation of any rights of another person or entity.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PlingifyPlug is established, without regard to its conflict of law principles. Any dispute arising from these Terms or the use of the Beta Software shall be resolved in the competent courts of that jurisdiction.

11. Conclusion

By using the Beta Software, you confirm that you have read, understood, and agree to these Terms. If you do not agree to these Terms, you should not use the Beta Software. We recommend that you carefully consider the risks involved before using any Beta Software provided by PlingifyPlug.
